1. Applicability

These terms and conditions apply to participation in the RooIce Auction, organised by the RooIce Foundation, both on the online platform https://veiling.rooice.nl and during the live Auction Evening.

By participating in the online or live auction, the participant agrees to accept these terms and conditions.

2. The Auction

  1. The online auction begins on the website at the time announced by the RooIce Foundation and runs until 10 December at 11:59:59.
  2. PM 11 December the live Auction Evening takes place in the marquee by the ice rink on the Market Square in Sint-Oedenrode.
  3. Lots that have received online bids will be continued or finalised live during the Auction Evening.
  4. The RooIce Foundation reserves the right to combine, split, or remove lots if necessary.

3. Buy Now Lots

  1. In addition to the regular auction lots, there will also be “Buy Now Lots” offered.
  2. These lots can be purchased at any time during the online period for a fixed price.
  3. Once a “Buy Now” lot has been purchased, it is immediately final and no longer available to other participants.

4. Bidding and Allocation

  1. A bid placed is binding.
  2. The highest bidder at the close of the auction is considered the winner.
  3. The RooIce Foundation is entitled to refuse or invalidate bids in cases of misuse or technical issues.

5. Payment and Invoicing

  1. All purchases will be invoiced by the RooIce Foundation after the auction.
  2. Payment must be made within the period specified on the invoice.
  3. Prices include VAT, unless stated otherwise.
  4. There will be no refunds following the purchase or allocation of a lot.

6. Collection of Lots

  1. Lots must be collected at the ice rink on the Market Square in Sint-Oedenrode., during or immediately after the Auction.
  2. The RooIce Foundation is not responsible for lots that are not collected.
  3. Uncollected lots may be re-offered or will revert to the RooIce Foundation.

7. Liability

  1. The RooIce Foundation organises the auction with the utmost care but is not liable for:
    • technical issues on the platform;
    • delays in communication or data transmission;
    • errors in the description of lots (unless due to intent or gross negligence).
  2. The participant is responsible for correct registration and bidding.

8. Privacy

Personal data will only be used for conducting the auction, invoicing, and communication with participants, in accordance with applicable privacy legislation (GDPR).

9. Force Majeure

In the event of force majeure (such as technical issues, weather conditions, or government measures), the RooIce Foundation reserves the right to postpone, extend, or cancel the auction without refund of any amounts already paid.

10. Final Provisions

  1. In situations not covered by these terms and conditions, the RooIce Foundation will decide.
  2. These terms and conditions are governed by Dutch law.
  3. Any disputes will be submitted to the competent court in ’s-Hertogenbosch.
